The courts finally favored Kelly Rutherford as she gets a temporary sole custody of her children after three years of appeals.
The "Gossip Girl" alumna is back in New York with her children, 8-year-old Hermes and 6-year-old Helena, after she won the legal right to have them stay with her while they are in the U.S. for the rest of the summer, the Daily Mail reported.
This is a big concession given by the courts to Rutherford who lost the custody battle back in 2012 and the court ruling prohibiting her from taking the children to the United States. The children remained in France with their father.
Rutherford had been excited with her reunion with her children, despite the temporary nature of the visit.
"It's incredible, it's emotional. We're all a little jet-lagged - but happy," she said an interview on "Good Morning, America!"
She added that her daughter learned to ride her bike in the park while her son rode his scooter.
She noted that it is a victory for her as her former spouse would only allow her to see them for short periods of time in Europe, according to Good Morning America as featured on Yahoo News.
Rutherford's ex-husband had been banned from entering the United States in August 2012 and had lived since then in Europe.
For the past three years, the Hollywood actress had to travel frequently to France, where her ex-husband now resides with the children.
This predicament, however, had prompted Rutherford to declare bankruptcy last year. In December 2013, the federal court also ruled that her ex-husband need not give financial support to Rutherford because the children are with him.
