Kelly Rutherford spoke with "Good Morning America" host Robin Roberts on Friday about her brutal ongoing custody battle for her two children, Hermes, 8, and Helena, 6. The actress lost the latest custody hearing on Tuesday after Giersch accused her of kidnapping the kids. A New York judge sent the two young children back to Monaco to live with their father, even though they and their father are American citizens.
"I walked into a courtroom where everything felt like it was already done. It was a done deal," Rutherford told "GMA's" Roberts Friday morning. "His mother was sitting there with plane tickets, smiling, ready to take them."
Hermes and Helena left for the airport with their paternal grandmother immediately from the courthouse, reported People magazine. "I'm glad they didn't have any notice, in a way I think it would've been harder," the "Gossip Girl" actress said of her goodbye to her children. "I was happy that it ended up happening because they didn't have to sit in the courtroom and watch it all happen or deal with media or anything that would have been sort of harmful."
The most recent courtroom drama happened after Rutherford refused to return the kids to her ex-husband and the kids father in Monaco last week, according to the New York Daily News, which prompted him to accuse the actress of child abduction. "I was accused of things I was not able to even defend," she said in the interview.
Rutherford did not agree with the allegations against her because she had always interpreted kidnapping to mean that someone does not know where their children are. "The kids were Skypeing with him every day," she said of Giersch. "I wrote him an email telling him exactly that nobody had jurisdiction in my country and I was concerned until somebody gave me some order that said they were coming back."
The next court date for Rutherford and Giersch is Sept. 3 in Monaco, where the two will work out custodial decision making and more. Check out the full interview below.
