Kim Davis may be due in court again as the debate over the relation of gay marriage, religion and government work continues.
The Rowan county clerk returned to work last week after spending some time in jail and making a pledge after she got out, saying that she wouldn't interfere with deputies who were issuing same-sex marriage licenses, according to NBC News.
However, according to a court motion filed Monday, the American Civil Liberties Union said she has broken her pledge and has begun to interfere with the other deputies.
When she was released from jail two weeks ago, Davis declared in front of a crowd of supporters, protesters and media that she would neither interfere or authorize marriage licenses, as reported previously by HNGN. In order to do this, she decided to remove her name from any and all licenses that are issued in Rowan County, according to the Washington Post.
Now instead of the licenses saying that they were issued under the authority of the county clerk, they now say they were issued "pursuant to Federal Court Order." By making this change, Davis intends to be both keep her job and maintain her conscience.
In light of this change, the ACLU believes the validity of the new licenses are "questionable at best," bringing "humiliation and stigma" to the gay couples who receive them, reported the Associated Press. They asked Judge David Bunning, the judge who has been residing over the case, to order Davis' office to reissue the licenses, and put the office in a receivership if she continues to interfere.
"The adulterated marriage licenses received by Rowan County couples will effectively feature a stamp of animus against the LGBT community, signaling that, in Rowan County, the government's position is that LGBT couples are second-class citizens unworthy of official recognition and authorization of their marriage licenses but for this Court's intervention and Order," the lawyers for the couples wrote in a court filing.
Davis' attorney Mat Staver did not directly respond to the ACLU's request for Bunning to put the office in a receivership, saying he would do so Tuesday. He says Davis has made a good-faith effort to comply with the court's order and believes "the ACLU's motion to again hold Kim Davis in contempt reveals that their interest is not the license but rather a marriage license bearing the name of Kim Davis. They want her scalp to hang on the wall as a trophy."
