Former Subway representative Jared Fogle is filing with the U.S. Court of Appeals for his $175,000 fine and the more than 15-year prison sentence he received for possession of child pornography and having sex with underage prostitutes following his plea deal.
Fogle, 38, pleaded guilty on Nov. 19 to one count each of child pornography possession and traveling across state lines for sex with minors, reported the Indy Star. His plea deal dictates that he isn't allowed to seek a prison sentence of less than 5 years or one longer than 12 years and seven months.
However, presiding federal judge Tanya Walton Pratt sentenced Fogle to more than 15 years in prison, going beyond the prosecution's recommendation of 12.7 years, and giving Fogle grounds to make an appeal.
The prosecutor of the case, Assistant U.S. Attorney Steven DeBrota, has declined to comment on the recent developments since Fogle's attorney, Ron Elberger, has yet to file a brief detailing the grounds for Fogle's appeal, and has until Jan. 25 to do so, reported the Associated Press. Once filed, the Seventh Circuit Court of Appeals in Chicago will hear the appeal and make a decision.
In the meantime, Fogle remains in Federal Transfer Center in Oklahoma City where he hopes the Bureau of Prisons grant his request t o move him to a correctional institution in Littleton, Colo. where he can continue receiving psychological treatment.
Fogle's scheduled release date is listed as July 11, 2029, reported the United Press International. Federal prisoners can leave early once at least 85 percent of their sentence is complete.
