Apple has found itself in the middle of a class-action lawsuit, as more than 100 disgruntled iPhone 4s users sued the tech giant after their devices became extremely slow after updating to iOS 9, according to Tech Spot.
The case, filed by Chaim Lerman and more than a hundred other plaintiffs, alleges that Apple intentionally did not inform its customers that the iOS 9 update would severely degrade the smartphone's performance in both its core functionality and ability to run third-party apps.
Lerman further stated that since there is no option to downgrade the phone's operating system to a previous iOS version, the iPhone 4s is made to be unbearably slow after the iOS 9 update forces users such to either live with an inefficient phone or upgrade to a newer, more expensive iPhone, reports Digital Trends.
In a sense, the case against Apple accuses the Cupertino, Calif., tech giant of planned obsolescence, a policy that companies utilize that involves creating products that become non-functional after a certain period of time.
As much as the case against Apple has merit, however, a similar lawsuit back in 2011 regarding planned obsolescence in relation to the iOS 4 update for the iPhone 3G was ultimately dismissed by the presiding judge, according to Yahoo! News.
Lerman and the other plaintiffs are seeking more than $5 million in damages, with the option to treble, which triples the initial amount being asked for. New York District Judge Sterling Johnson Jr. is set to preside over the case.
