The attorneys for the parents of a Saratoga girl who killed herself after photos of her alleged sexual assault were texted to classmates said Monday that the boys also wrote horrible words on her body that "served to taunt and demean her."
Audrie Pott, 15, hanged herself Sept. 10 in a bathroom at her mother's house, eight days after she went to a party at a friend's house in Saratoga with 12 other students. After drinking alcohol-laced Gatorade, she fell asleep and woke up without her shorts on and with mocking words written in several places on her body.
"The student newspaper reported that 10 kids had seen the photo; we'd like to talk to those 10 kids," said Larry Pott, Audrie's father.
The three boys accused of violating her were arrested last week on suspicion of sexual assault by digital penetration and distributing a photo of a minor in sexual positions - both of which are felonies in California.
Audrie's father, Lawrence Pott, and her mother, Sheila Pott, filed a wrongful death lawsuit Monday in Santa Clara County Superior Court against the three boys arrested Thursday in connection with Audrie's death.
The family said it would file a lawsuit today in Santa Clara County Superior Court against the three teenagers and the owners of the home where the alleged assault occurred.
The boys were arrested Thursday - eight months after Audrie Pott posted online that her life was ruined and then hanged herself.
"This period has been difficult for us because the wounds are so fresh," her father said. "We miss her every day, but now we must carry on and share her story so that this epidemic of sexual assault and cyberbullying amongst teens can be exposed and stopped."
