Rapper 50 Cent Will Have To Pay In Video Lawsuit, New York Judge Denies Request For Case Dismissal

A New York Judge denied rapper 50 Cent's request for the courts to dismiss a lawsuit filed by a Florida woman over a sex video featuring her posted online by the rapper without her consent, according to the Associated Press.

Lastonia Leviston filed a lawsuit against 50 Cent, or Curtis James Jackson III, for unspecified damages in 2010 after he edited a sex video with Leviston and her then current boyfriend, Maurice Murray, to show a character named "Pimpin' Curly" having intercourse with her instead, the New York Daily News reported.

Court documents state Murray gave the tape of him and Leviston having sex to Jackson who recognized her as the mother of rapper Rick Ross' child, his nemesis at the time due to a rap war where Ross had starting calling Jackson "Curly," the Daily News reported.

Jackson asked for the dismissal of the lawsuit but the judge rejected his plea and and made the ruling public on Thursday, according to the AP.

According to Jackson, the tape features Leviston having sex with Murray in 2008, the AP reported. The judge's decision states the tape was given to the rapper by the boyfriend without Leviston's permission.

Court documents show Jackson said in a sworn deposition he inserted himself in the video as a fictional character called "Pimpin' Curly" to "mock" Ross, according to the Daily News.

In the edited version of the video posted online, Murray's face is blurred but Leviston's is not, the Daily News reported.. Jackson added he had nothing to do with the video being uploaded to the internet and insists it was legally fair to use to images in the video.

Leviston sued for mental and emotional distress after the video was posted online and received 3.2 million hits, the Daily News reported. According to the judge, "there was enough evidence for the jury to determine the merits of Leviston's claims for mental and emotional distress."
