An attorney for Shayanna Jenkins, the fiancée of ex-NFL star Aaron Hernandez, plans to file a motion for the dismissal of Jenkins' perjury charge. Jenkins' attorney believes there isn't any evidence to support the prosecution's allegations her client was untruthful, the Associated Press reports.
Jenkins' attorney mentioned her plans to file for a dismissal during a hearing on Monday in the Fall River Superior Court. The attorney cited a lack of evidence to support the Commonwealth's perjury charge, which stems from Jenkins' testimony before a grand jury on Aug. 13 and Aug. 15.
Jenkins was indicted in September for one count of perjury. The prosecution contends Jenkins lied at least 29 times during her testimony to the grand jury investigating Hernandez.
Specific instances of Jenkins lying, according to the Commonwealth, include (via the Providence Journal):
"-Jenkins 'did not have any conversation with Aaron Hernandez' about why the police dropped by his North Attleboro mansion to question him about the June 18 murder of Odin L. Loyd.
-She saw only one gun in the home she shared with Hernandez and their baby daughter.
-She denied having a conversation with Hernandez when he called her on June 18 from his lawyer's office in Boston.
-She doesn't remember what items she removed from their home or how she removed them at (Hernandez's) direction.
-She doesn't remember where she went after she dropped off Hernandez at the North Attleboro police station."
Court documents also indicate investigators believe Jenkins may have hid the firearm used to kill Lloyd. Jenkins was released on her own recognizance after pleading not guilty to the charge during her initial arraignment.
Hernandez was charged with first-degree murder in the shooting death of Lloyd; the ex-NFL star pleaded not guilty and is currently being held without bail while awaiting trial.
A search warrant released on Tuesday indicated police suspect Hernandez was involved in a 2012 unsolved double homicide in Boston.
