A woman claimed a man who was shot by police in New Mexico on Saturday was not doing anything wrong at the time of the incident, the Las Vegas Optic reported.
The shooting occurred on Interstate 25, when a man -- 72-year-old Albert Urban of New York -- was driving on the wrong side of the road. According to police reports, an officer shot at Urban once he began driving "aggressively towards one of the officer."
Helen Vargas, who witnessed the scene, disputed the police account and said Urban was not "aggressively driving" towards any officer. She said he was shot right in front of her home and that all allegations against Urban are false.
However, Urban is being charged with aggravated assault on a law enforcement officer and aggravated fleeing. He is currently recovering and is in stable condition at UNM Hospital.
A spokesman for the State Police said the investigation into the matter is ongoing.
