Tori Spelling, Dean McDermott Divorce Update: Was Couple Evicted From Pricey California Home?

Tori Spelling and her husband Dean McDermott were ordered to "pay or quit" their Los Angeles rental home, Radar Online reports. A landlord for the Tarzana property posted a legal notice on the front of the gate on Jan. 6 demanding that the family pay the rent or get out.

Reportedly, Spelling and McDermott failed to pay a month's worth of rent totaling $7,750 but quietly moved out of the house on Dec. 15, eight and half months after they moved in.

According to TMZ, the whole thing is a big misunderstanding. Spelling and her family did move out of the house but also claims they paid the money owed to the landlord. The actresses lawyer told TMZ that the legal notice was "a clerical letter" and the family forked out enough money to cover the rent until the end of January.

Spelling's rep told the site that the family was having some issues with the landlord and decided it was best for them to vacate the property before their lease was up.

"[The] landlord was a nightmare and failed to repair numerous items [in the house]," the rep said.

Spelling and her family now live in a more expensive house a couple minutes away. It's not clear if their old landlord will come after them for breaking the lease. The couple has been plagues with rumors hinting at financial troubles and cheating allegations.

Allegedly McDermott had an affair with a 28-year-old Canadian woman. Neither one has addressed the rumors surrounding their marriage. One of the reasons Spelling might be keeping tight-lipped is because she doesn't have a prenup. According to Radar the former "90210" actress didn't want to sign one when she married McDermott in 2006.

"Dean offered to sign one, but Tori refused," a source told Radar. "She truly believed Dean was her soul mate and there was zero need for a prenup."

"With the recent allegations that Dean cheated on Tori, she's now kicking herself for not securing the prenup with Dean," the source continued. "She doesn't plan on divorcing Dean, but feels that a preupp might could have prevented him from cheating on her."
