A federal judge has temporarily dismissed New Mexico's gun ban.
US District Judge David Urias explained why he granted a temporary restraining order against the firearm restriction imposed by the state's governor.
US Federal Judge Dismisses New Mexico's Gun Ban, But Why?
According to NBC News' latest report, New Mexico Gov. Michelle Lujan Grisham issued a gun ban on Friday, September 8. Many gun rights supporters criticized her decision. Now, Urias decided to freeze the 30-day firewarm regulation on Wednesday, September 13.
The US federal judge explained that the gun restrictions in Albuquerque, the largest city of New Mexico, and its surrounding county are against a landmark US Supreme Court ruling. Urias specifically referred to the ruling that gives people the right to carry guns outside their residences for self-defense purposes.
"They just want the right to carry their guns," said the US district judge via Reuters.
New Mexico Governor's Gun Ban Could Lead to Federal Charges
Andrew C. McCarthy, the former Assistant United States Attorney for New York Southern District, said Grisham should face federal charges.
The ex-prosecutor explained that because the New Mexico governor decided to suspend constitutional gun rights in her state, she should be charged under the same statute used against former POTUS Donald Trump.
McCarthy claimed that Grisham and her subordinates obviously conspired to oppress, intimidate, and threaten Americans in New Mexico in the free exercise of their Second Amendment rights.
But, Grisham defended her decision, saying that gun restriction is necessary to reduce gun violence and illegal drug use in the state. Michelle vowed that she would not be resigned to the status quo. The US official also called on state leaders and law enforcement officials to stand with her to enact the solutions she believes can save Americans' lives.
The New Mexico governor announced the 30-day firearm restriction after the recent shooting incident on September 6, where an 11-year-old boy was killed.
Currently, Albuquerque is considered one of the ten most dangerous US cities. Meanwhile, New Mexico ranks sixth among the US states regarding gun-related deaths, with over 500 people dying annually.
