The Biden Admin's ghost gun restrictions can continue after the US Supreme Court after it adheres to the government's request. This was announced on Monday, October 16.
With this decision, two Texas-based ghost gun manufacturers are barred from selling their at-home firearm kits.
This is the second time the US Supreme Court has acted against the order of Forth Worth-based Judge Reed O'Connor.
Biden Admin Ghost Gun Restrictions Can Continue
According to The Guardian's latest report, the latest decision of the US Supreme Court was specifically made to halt the rapid proliferation of ghost guns, 3D-printed firearms that can be assembled at home.
On September 14, Reed O'Connor introduced an injunction that barred the enforcement of a 2022 federal regulation. This rule restricted privately made guns, specifically those manufactured by Defense Distributed and Blackhawk Manufacturing.
But, with the latest order of the US Supreme Court, issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), O'Connor's injunction has been reversed.
Yahoo Life reported that the brief order allows the Biden Administration, specifically the Department of Justice, to continue its ghost gun regulations.
In the DOJ's emergency application to US Supreme Court justices, Solicitor General Elizabeth Prelogar argued that the district court judge ignored an order originally issued by the Supreme Court in August.
She referred to the 5-4 court vote favoring the Biden Administration. Meanwhile, Biden Admin officials explained that although the majority disagreed, O'Connor still granted an injunction favoring these 3D-printed guns.
They added that the judge's decision clearly shows that he "openly flouted" the supreme court's authority.
Dangers of Ghost Guns
Although the firearm's name already provides a negative feeling, many people are unaware of the real risks posed by these ghost guns.
If you are among these individuals, the Yale Law School provided the reasons why ghost guns are facing restrictions:
- Most ghost guns lack serial numbers that law enforcement needs to trace. This is why some criminals are attracted to purchasing these weapons.
- Even without background checks, Americans can easily obtain or create the components of ghost guns. Because of these, there's a high chance that the firearm can malfunction, endangering the lives of its users.
- Unlike traditional guns, ghost guns are usually made of plastic. This means that X-ray machines can't detect them easily, which could allow criminals to bring weapons in crowded places.
