Jamie Foxx, who was sued regarding an alleged sexual assault that occurred in 2015, has denied the allegations. Foxx, whose real name is Eric Marlon Bishop, is facing a lawsuit filed by a woman who alleges she was sexually assaulted by the actor eight years ago at a restaurant in New York City.
The accuser, identified as "Jane Doe," claims that Foxx groped her without her consent after she requested a photograph with him. The lawsuit also implicates the restaurant owner, Mark Birnbaum, for failing to protect the victim during the incident, as per BBC News.
Jamie Foxx Sued Over Alleged Sexual Assault
The alleged assault is said to have occurred on August 26, 2015, around 01:00 in the morning at Catch NYC, where the woman was seated at a table adjacent to Foxx.
According to the lawsuit, Foxx appeared to be intoxicated but agreed to take photos with the woman. During this interaction, he made inappropriate comments, stating that she had a "supermodel body" and smelled "so good."
The lawsuit details that Foxx then led the woman to a secluded area of the restaurant, where he allegedly touched her breasts and placed his hands inside her underwear without her consent. The incident came to an end when the victim's friend intervened.
The legal action also targets restaurant owner Mark Birnbaum, alleging that he and the restaurant's employees failed to fulfill their responsibility of care to the plaintiff by not ensuring her safety during the encounter.
As a result of these alleged actions, the woman claims to have suffered severe emotional distress, anxiety, humiliation, embarrassment, post-traumatic stress disorder, and other physical and emotional damages.
This lawsuit comes shortly before the New York Adult Survivors Act's expiration date on November 24, 2023.
The act allows alleged victims of sex crimes to pursue legal action even after the statute of limitations has expired. Notably, several high-profile figures, including former President Donald Trump, rapper Sean Combs, comedian Bill Cosby, actor Cuba Gooding Jr, and Russell Brand, have faced lawsuits under this act, according to Variety.

The music industry veteran Jimmy Iovine has also been sued by a woman who alleges sexual abuse and harassment in August 2007. Iovine, a co-founder of Interscope Records and a prominent figure in the music industry, expressed shock and disbelief at the allegations.
