On Wednesday, two fans filed a lawsuit in Brooklyn federal court against Madonna for starting her concert late in New York City, claiming they "had to get up early to go to work" the following day.
The lawsuit stated Michael Fellows and Jonathan Hadden bought tickets to a December 13 show at Barclays Center as part of Madonna's 'Celebration' tour.
According to the lawsuit, the show was advertised to start at 8:30 pm, but the pop star did not take the stage until after 10:30 pm.
The two were stranded in the middle of the night with limited public transportation, ride-sharing, and increased public and private transportation costs when they left the concert after 1 am.
The lawsuit claimed they could not take care of their family responsibilities the next day due to the late finish of the weeknight show.
Fellows and Hadden accused Madonna, Barclays Center, and tour promoter Live Nation of being immoral, unfair, and deceptive trade practices for the delayed start time. The two argued that it was a violation of contract and "a wanton exercise in false advertising."
Furthermore, the lawsuit requests class-action status for those who attended previous 'Celebration' tours that started late, including Madonna's two concerts in New York on December 14 and 16.
There are often delays in the live music industry, but Madonna has been sued twice in similar lawsuits.
The first lawsuit in 2019 was filed by a Florida fan who argued that Madonna's tardiness on her 'Madame X' tour was a breach of contract. In 2020, a lawsuit was filed by two New York concertgoers.
Both lawsuits were later voluntarily dismissed.
Madonna's current 'Celebration' tour was rescheduled from last July after the singer was hospitalized due to a bacterial infection. The tour continues until its final stop in Mexico in April.
Madonna Hospitalized Due to Bacterial Infection
Madonna was hospitalized due to what her management calls "a serious bacterial infection." It is unclear if the 64-year-old singer is still receiving medical attention.
Her 'Celebration' tour, scheduled for July 15 in Vancouver, has been postponed. The tour marks her 40th anniversary as a singer.
Madonna's longtime manager, Guy Oseary, wrote on Instagram: "On Saturday, June 24, Madonna developed a serious bacterial infection which led to a several day stay in the ICU. Her health is improving, however, she is still under medical care. A full recovery is expected."
Fox News medical contributor Dr. Marc Siegel said that the most common would be the possibility of pneumonia or a urinary infection that could infect her blood and lungs. Siegel noted that a stay in the ICE was a "very serious" thing because it shows that a person was currently in a life-threatening situation.
