No Jail Time For 12-Year-Old Who Raped His Younger Sister; Judge Says He Is Unlikely To Offend Again

A U.K. judge ruled that a boy who raped his 7-year-old sister when he was 12 poses no danger to society, and that it is "highly improbable" he will rape again, The Independent reported Monday.

The series of sexual assaults occurred between March and May 2013. The boy, who is now 13, raped his sister after watching hardcore pornography with friends. The porn gave him "a desire to try it out," according to The Independent.

The teenager pleaded guilty to rape, two counts of indecent assault and inciting a child to engage in sexual intercourse. He said he was "disgusted" by his actions and vowed to never do it again.

District Judge James Prowse of the Blackburn Youth Court said the boy is not likely to reoffend because of the "unsophisticated" and "immature" reasoning that lead to the sexual assault, The Independent reported. Prowse also said sending the boy to prison would place him around "hardened and sophisticated" offenders.

The boy's sister said she misses her brother despite what he did.

"I feel sad what the (defendant) did," the sister said, according to The Telegraph. "I want him to go to our house so I can play games with him. I love (the defendant)."

The boy's sister said her brother assaulted her six times. The boy allegedly wanted to carry out what he saw after watching porn on an Xbox at a friend's house.

"When you started watching pornography you had a desire to try it out, having watched what adults were doing," Prowse said, according to The Telegraph.

The judge made a point of addressing the easy access to explicit images that kids have today.

"Society's view on pornography covers a wide spectrum from complete condemnation on the one side to being laissez faire on the other but even the most liberal-minded share society's profound unease that children of your age can and do access the internet and watch graphic images of sexual intercourse," Prowse said according to The Telegraph.

The boy will have to spend two years as a registered sex offender. Social workers will help the boy return to live with his family in a few months, according to The Independent.
