A Florida man allegedly shot a gun near police officers Tuesday and then decided to help himself to a cold beer.
Port Orange Police Department showed up to the neighborhood after they had received a call about a person who had been threatened by a neighbor with a firearm.
Officers arrived on scene and while investigating, bodycam footage shows the suspect, identified as Brett McPeek, exiting his residence after firing a gun in the area of the officers, victim, and several neighbors who were outside at the time.
Body camera video shows the officer with his gun drawn talking to McPeek, who was holding two beers.
"This beer is cold, sir. I wanna drink it," McPeek told the officer. "Come check me. I wanna drink this beer. Is that cool? I haven't done nothing wrong."
The officer then directs McPeek to raise his hands. "Right now, we are trying to figure out what's going on, bud, and we wanna make sure everybody's safe," the officer said. Officers continued speaking with McPeek and ultimately took him into custody.
When McPeek was apprehended, he did not have the firearm in his possession. However, during the execution of a search warrant at his property, authorities discovered two handguns, including a .38 Special revolver containing a spent shell casing.
McPeek was booked into the Volusia County Branch Jail with no bond, facing charges of aggravated assault with a firearm and using a firearm while under the influence of alcohol.
