Chris Brown has to return to a California jail after his assault trial was delayed for the next few months. The 24-year-old singer is expected to once again be shackled and flown back to Los Angeles on "Con Air," an inmate transportation system, CNN reports.
The delay in Brown's trial comes after his bodyguard, Christopher Hollosy, was found guilty of assault in a Washington, D.C. court. The delay was also due to prosecutors refusing to grant Hollosy immunity so he could testify in Brown's trial.
Brown and Hollosy were arrested in October after a man accused them of beating him up outside the W Hotel. The man alleges that he photobombed a picture the "Love More" singer was taking with a female fan when Brown punched him.
According to reports, the bodyguard would more than likely be expected to testify that it was him who punched the man and not Brown. CNN reports that part of the reason Hollosy was not granted immunity was because he would not talk to the prosecutors about his testimony. They also believe he will lie to help Brown's case.
Following the trial, Hollosy's lawyer, Bernard Grimm, told a judge that he planned on appealing the guilty verdict. Mark Geragos, Brown's lawyer, tried to get a Los Angeles judge to free the singer so he could travel back from Washington on his own but the request was denied.
"I think it's a little over the top to have him in custody on this misdemeanor when everybody saw the bodyguard's trial and which was nothing more than a bloody nose," Geragos told reporters, according to CNN. "And you have for the bodyguard who was convicted and who readily admitted he was the one who did the punching. So all of this is much ado about nothing."
According to CNN, Assistant District Attorney Mary Murray said she did not want Brown released because the only change in his assault case was that it has "gotten worse." When Hollosy was found guilty, the Washington judge also said that the singer was "the initial aggressor" in the incident.
So far, Brown has been in jail for 39 days. He was sent to a Los Angeles jail after he was kicked out of rehab, which was a violation of his 2009 probation.
