Robert Downey Jr.'s son, Indio Falconer Downey, is facing a three-year prison sentence after being arrested for cocaine in June.
The 20-year-old was charged with "one felony count of a controlled substance and a misdemeanor count of possession," according to the New York Daily News.
Indio was arrested in West Hollywood for suspicion of cocaine and drug-paraphernalia possession, after a police officer allegedly found him smoking a pipe in a car with two other individuals. The vehicle was reportedly pulled over during a traffic stop.
"The deputy drove up near him and saw him using a cocaine pipe," Sgt. Dave Valentine previously told The Daily News. "That was the reason for the stop. He was the front-seat passenger."
Since Indio is a first-time offender, he will automatically be entitled into a drug diversion program - however, the young man is facing a maximum sentence of three years and six months in prison, if convicted on both counts.
Daily News reported that the charges were filed on June 30. Indio's arraignment has been set for Aug. 29 at the L.A. Superior Court Airport Courthouse.
Indio's father, Robert Downey Jr., publicly struggled with drugs during his career and was arrested several times on drug-related charges. The "Iron Man" actor released a statement regarding his son's arrest, saying "Unfortunately, there's a genetic component to addiction and Indio has likely inherited it."
He continued: "Also, there is a lot of family support and understanding, and we're all determined to rally behind him and help him become the man he's capable of being. We're grateful to the Sheriff's department for their intervention, and believe Indio can be another recovery success story instead of a cautionary tale."
People Magazine reported that Indio voluntarily checked himself into rehab just days after he was arrested.
