Actress Katherine Heigl has voluntarily dropped her $6 million lawsuit against drugstore chain Duane Reade after working out a "mutually beneficial agreement," according to The Hollywood Reporter.
The former "Grey's Anatomy" actress sued the popular chain in April with claims that it had "improperly exploited" her name and likeness in pictures taken by paparazzi of the actress carrying Duane Reade shopping bags.
"Love a quick #DuaneReade run? Even @KatieHeigl can't resist shopping #NYC's favorite drugstore" a tweet from chain's twitter page read, but has since been deleted.
According to THR, the actress launched the lawsuit in Manhattan federal court on claims that the chain violated "the false advertising provision of the Lanham Act as well as New York civil rights statutes protecting use of likenesses for purpose of trade."
The "Knocked Up" actress sought $6 million in compensatory and punitive damages. Her lawyer Peter Haviland said the terms of the agreement are confidential and that the dismissal is considered prejudicial, which means Heigl cannot refile the suit at a later date.
Her attorney told THR that "Katherine Heigl and Duane Reade have worked out a mutually beneficial agreement. Ms. Heigl has voluntarily dismissed her lawsuit, and Duane Reade has made a contribution to benefit the Jason Debus Heigl Foundation. The parties have agreed to keep the terms of the agreement confidential."
Heigl is set to make her first return to TV in several years in the new NBC series, "State Of Affairs," where she will play a CIA analyst who advises the US president.
