Customers brought Red Bull to court claiming their advertising, including the "Red Bull Gives You Wings" slogan, is misleading and false.
The plaintiffs are saying the energy drink advertisements make the drink seem superior to other energy sources and can increase your performance, concentration and reaction speed.
"Such deceptive conduct and practices mean that [Red Bull's] advertising and marketing is not just 'puffery,' but is instead deceptive and fraudulent and is therefore actionable," the suit says.
Advertisements don't specifically say that Red Bull has more caffeine than coffee - which it doesn't - but the suit points out that the company says the product is worthy of a higher cost than coffee or other sources of caffeine.
"Red Bull settled the lawsuit to avoid the cost and distraction of litigation," the company said in a statement. "However, Red Bull maintains that its marketing and labeling have always been truthful and accurate, and denies any and all wrongdoing or liability."
The settlement will be heard in May 2015.
As for now, anyone who bought a can of Red Bull between Jan. 1, 2002 and Oct. 3, 2014 are eligible to receive either a cash payment of $10, or $15 worth of Red Bull products. Claims must be made before March 2, 2015.
If the settlement is approved in May, customers who made claims will receive their payments within 150 days of the final approval of the settlement.
