Jodi Arias' Sentencing May Come On Monday

Jodi Arias' final sentencing may come on Monday, USA Today reported.

Kirk Nurmi, part of her defense team, made one last attempt on Friday to have the death penalty thrown out, alleging misconduct on the part of the prosecution and inability to get witnesses to come to the stand to defend Arias because testimony was forbidden in a closed court room.

A rule will come by Monday, according to Sherry Stephens, the Maricopa County Superior Court Judge. She denied a motion to have her sentencing retrial halted while she appeals a court's ruling allowing the public access to her court transcripts.

Arias has already been found guilty in the 2008 murder of her on again, off again lover Travis Alexander, who was found dead in the shower of his Arizona home. He had suffered more than 20 stab wounds, a slit throat and had been shot in the head.

She first went to trial in 2013, but the jury didn't come to a unanimous verdict on whether Arias should be executed or spend the rest of her life in prison.

The courtroom was closed to the public by Stephens during the testimony of Arias' first defense witness, who later ended up being Arias herself. The previously-secret witness was uneasy and wouldn't testify unless the public was shut out, so the judge said it was necessary, according to CBS News.

Media outlets sued for access and won in the Arizona Court of Appeals, and Stephens has now called for the release of court transcripts from the two closed-trial days. They should be accessible by next week.

But Nurmi said that Arias has never had a fair trial.

"It's game over," he said. "She cannot present a good defense."
