Mother Claims Chicago School Neglected Son's Harrassment by Classmate

A woman is suing Chicago's school district for allegedly neglecting her son's sexual abuse by two of his kindergarten classmates last year.

The unidentified mother of the Wendell Smith Elementary School student filed a lawsuit naming the Chicago Public Schools and the Board of Education as defendants for negligence and violating her son's rights to avoid abuse and harassment, according to Chicago Sun-Times.

The abuse started in January 2014 when the teacher allowed the students to use older kid's bathroom without supervision, the Associated Press reported. A school worker heard the boys fighting in the bathroom and saw that both were naked from waist down. The principal was informed and called the parents after the mother learned from her son that the other boy demanded sexual acts from him.

Despite informing the district and board officials of the incident, the teacher still allowed her son to use the bathroom with the same boy, which led to abuse on two more occasions. The mother also claims that the cousin of the boy also abused his son one time. The teacher was also accused of shamming her son by saying he is doing "nasty things" in the bathroom.

The lawsuit also stated that the school never told other parents that the kindergarten was allowed to use older kids' bathroom without supervision, ABC News reported.

CPS officials didn't comment on said issue, since it is still a pending litigation and they haven't reviewed the lawsuit yet. They added that they are making the students' safety and well-being their top priority.
