Kelly Rutherford has been reunited with her children one month after a New York Judge demanded that she return the children to Monaco to live with their father, Rutherford's ex-husband Daniel Giersch, Us Weekly reported. The actress posted a sweet photo of her cuddling her children to her Instagram following a Thursday court appearance in an ongoing custody battle between the exes.
The "Gossip Girl" actress posted the black and white photo to her Instagram of her with her arms around her two children. Her head turned to the side, kissing her 8-year-old son Hermes on the forehead as her 6-year-old daughter Helena looked on.
They were spotted out to lunch together in the South of France on Friday. Rutherford, 46, spend two hours in a Sept. 3 court hearing in a fight to bring her children back to the U.S., where they both were born, according to People.
The children have been living with Giersch, 41, after a judge ruled in his favor in 2012 and sent the children to live with him in Monaco and France. The couple split in 2008 and have been involved in a custody battle ever since.
Wendy Murphy, Rutherford's attorney, stressed that the children are U.S. citizens and should have never been ordered to leave the country in August, after Rutherford refused to send her children back to Monaco following a summer visit.
"Monaco has no interest in the children," Murphy explained. "We will be showing the Monaco judge the father's agreement 'never' claimed that the children ARE residents of Monaco, or should be declared residents of Monaco."
There is currently no word on how the judge ruled in the Sept. 3 hearing.
