Jamie Spears, Britney Spears' estranged father, filed legal filings with the California Court of Appeals on Monday, arguing the court was unfair in requiring him to appear for a deposition but not his daughter.
On July 27, the judge ordered that the 40-year-old Grammy winner would not be disposed of in the conservator abuse case, but that the 70-year-old former building contractor might seek written papers from her.
Jamie Spears' Lawyers Are Pushing Back at Deposition
Britney Spears' attorney, Mathew Rosengart, contended that a deposition may re-traumatize her after effectively ending her 13-year conservatorship under Jamie's authority on November 12.
In documents obtained by TMZ, Jamie's attorney Alex Weingarten stated that "the right to take a deposition may seldom be rejected." The elder Spears feels that if the younger Spears can submit written responses, so should he.
According to the legal documents filed in the California Court of Appeals, Jamie Spears believes it is unfair that only he had to take a deposition when there were two people involved in the case; he believes she should also take a deposition. "The right to take a deposition can rarely be denied. Discovery is a matter of right in California."
Jamie Spears' counsel says that the justification given by the counterpart's attorney, Mathew Rosengart, for her lack of a deposition was insufficient to excuse her from appearing in court, Marca reported.
