A Texas man allegedly attacked a tow truck driver who was trying to take away his mother's car.

It happened after midnight early Friday in Plano when Michael Guevarra, 19, and his mother went to a parking garage and found a tow truck driver hooking up the car, the local police department reported.

The driver had papers allowing him to take the vehicle, according to KDFW-TV.

Police say Guevarra grabbed a metal bar and struck the tow truck driver three times over the head. The driver then pulled out a gun and fired a round, police reported. The bullet missed and hit a wheel.

Guevarra was arrested and charged with aggravated assault with a deadly weapon.

The tow truck driver was not cited.
