Xbox Live has always has a system to punish volatile players who abuse the Xbox Live Code of Conduct. The same is true for the next-gen console's Xbox One Upload Studio. Users will be banned for violating the code of conduct, this includes "excessive profanity." With the Xbox One hot off its day one release, which saw the Microsoft-based console sell more than one million units in less than 24 hours, it's important for users to know the codes of conduct as well as the punishments for violating them.
The consequences of this ban seems to affect Skype functionality, which has led many to believe that Microsoft would be listening to people's personal voice calls via Skype and suspend accounts for swearing or other foul language during their conversations. However, Microsoft and Xbox Live have come out with a statement to assure its users that this is not the case.
"To be clear, the Xbox Live Policy & Enforcement team does not monitor direct peer-to-peer communications like Skype chats and calls," a Microsoft representative tells IGN. "Also, we take Code of Conduct moderation via Upload Studio very seriously. We want a clean, safe and fun environment for all users. Excessive profanity as well as other Code of Conduct violations will be enforced upon and result in suspension of some or all privileges on Xbox Live. We remain committed to preserving and promoting a safe, secure and enjoyable experience for all of our Xbox Live members."
As IGN notes, what's probably going to happen is that Gold accounts with suspensions placed on them will prevent the users from accessing other Gold-enabled features such as the Upload Studio/DVR and Skype as well as any online multiplayer for games.
